Terms of Business - Family Portraits and Pet Portraits

1. PAYMENT TERMS

• The Booking Fee covering the cost of the Portraiture Session is payable on booking to confirm the Session
• There is no charge for travel up to 10 miles from Maidenhead. Beyond this there is a scale of charges to cover mileage.
• Pricing and products are subject to regular review and change. Re-order prices are those stated at the ime of placing the order.
• The viewing session provides the opportunity to order portraits and display formats; a discretionary charge of £25 may be made for a second viewing. There is no obligation to purchase.
• Payment can be made through the following major debit and credit cards: VISA, VISA Electron, MasterCard, Maestro, SOLO

2. CANCELLATION AND POSTPONEMENT

• In the event of cancellation all Booking Fees are non-refundable. In the event that the booking is rearranged to take place within one month of the booked date, no charge will be made for the first rearrangement. If the rearrangement is more than one month later the Photographer will at her discretion charge the cost of the Booking Fee and prices current at the date of the new photo-shoot will apply. If a second rearrangement is required the cost of the Booking Fee will apply.

3. PRODUCT DESCRIPTION

• Sizes quoted are approximate. Image size of finished portrait is approximately 4.5mm less on each side as the portrait sits behind the aperture.
• We will endeavour to take all the photographs discussed. However, it may not be possible due to circumstances beyond our control eg. bad weather conditions.
• We will not submit all the photograhs we take, the final selection of prints submitted will be entirely at our discretion.
• Lucy Badham will re-take any photograph where she has seen that someone has blinked, but cannot guarantee to see them all in large groups of people.

4. PERSONAL DATA

• Digital files are retained for a minimum of 3 years.
• Lucy Badham reserves the right to use the digital files and any prints from Pet Portraiture sessions for display, promotional and other purposes. The pet owner will be asked to sign a standard release form for permission of usage of the photographs
• Family portraiture customers will be asked on the order form whether they give permission for Lucy Badham to use images from the photoshoot for display/ advertising/ website/ direct marketing and competition purposes. 
• Your contact details will not be disclosed to any third parties

5. COPYRIGHT

• The 1998 Copyright Act assigns copyright to Lucy Badham. It is contrary to the Act and strictly illegal to copy or to allow to be copied, any photographs covered by this contract.

6. COMPLAINTS

• In the event of a complaint please refer to the Complaints Policy
• The responsibility of Lucy Badham or her suppliers (including professional processing laboratories, framing suppliers, postal and delivery agents) to compensate the customer in the case of negligence or breach of contract is limited to the cost of the booked service at the time of booking.
